Recommendation

Action Proposed:

Repeal Board Rules 1301 through 1320 (Chapter 6 in its entirety) pertaining to the Use of School Facilities for Non-School Purposes (the Rules), and replace the entire section with Board Policy 1330 (Attachment A), pursuant to Board Resolution 021-25/26, Building Stronger Communities: Leveraging School Facilities for Engagement and Financial Stewardship (Attachment D), and in alignment with the California School Boards Association’s (CSBA) GAMUT Policy Manual. Board Policy 1330 is aligned with the Board’s broader goal towards full implementation of updated Board bylaws and Board policies.

Body

Background:

The Board adopted Building Stronger Communities: Leveraging School Facilities for Engagement and Financial Stewardship (Res-021-25/26) on November 18, 2025. Updates on the implementation of the Board Resolution have been provided through Board Informatives in April and September, and presentations at a Regular Meeting of the Board of Education in May 2026, and to the Board’s Facilities and Procurement Committee in May and September 2026.

The proposed Board Policy 1330 is anchored by the CSBA’s policy on the use of school facilities and takes into consideration  the current Board Rules, applicable law, Board Resolution 021-25/26, current uses and practices, and the practices of neighboring school districts. Based on this review, staff is recommending the Board repeal Board Rules 1301 through 1320 (Chapter 6) and replace it with Board Policy 1330 (Attachment A).

Should this proposal be adopted, the Superintendent will prepare administrative regulations consistent with Board Policy 1330. Board Policy 1330 and its administrative regulations will supersede all Board Rules, Bulletins, and Reference Guides currently governing the non-District use of schools.

The Board is in the process of a broader initiative to review and amend its policies. Board Policy 1330 will take effect immediately as a Board Rule under the current Board Rule adoption process and will be incorporated into the Board Policy Manual in sequence with the completion of the Board Policy Update Project, which is expected to be completed in late 2027 or early 2028.

Expected Outcomes:

Approval of the recommended action will replace existing Rules to be consistent with Board Resolution 021-25/26 and clarify current practices. Board Policy 1330 will provide clarity and guidance for the subsequent administrative regulations to minimize risks and liabilities, preserve school facilities and allow community use.

Board Options and Consequences:

A “yes” vote will repeal Board Rules 1301 through 1320 (Chapter 6) and adopt Board Policy 1330, advancing the Board’s Building Stronger Communities resolution (Res-021-25/26). A “no” vote will keep the current Board Rules in place.

Policy Implications:

The recommended action has a direct policy implication. By amending the Rules, the Board is updating its policy on community use of school facilities. Where a conflict exists, applicable federal or state law will govern.

Budget Impact:

Adoption and implementation of the Board Policy will require staff time for training, communications, and ongoing administration. No additional staff is contemplated, so implementation is expected to be cost-neutral to the District’s budget.

Staff will adopt a tiered fee schedule consistent with the law. Any reduced, waived, or discounted fee must be included in the schedule. Fees may recover the District’s direct costs, including the community’s share of capital costs (maintenance, repair, restoration and refurbishment of non-classroom facilities and grounds) and operating costs (such as utilities, supplies, custodial services and staff costs). Fees collected for capital costs must be deposited in a special fund used only for capital maintenance, repair, restoration, and refurbishment of school facilities as required by California Code of Regulations Title 5, Sections 14037 through 14042. A portion of eligible income may be shared with the host school. Parent Teacher Associations (PTAs) and Parent Teacher Student Associations (PTSAs) with a District contract, and qualifying booster clubs, are not charged for activities that support their school.

Student Impact:

The amended Rules protect student activities and extracurriculars by keeping District programs, including instruction and student activities, first in line and by strengthening safety, supervision, insurance, and facility-protection requirements for community use. Returning a portion of eligible net revenue to host school sites’ 4242 discretionary accounts lets approved community use support school-site purposes in accordance with District budget and accounting requirements.

The amended Rules may also increase community access to school facilities, which can expand educational, recreational, cultural, civic, and enrichment opportunities for students and families when those activities are compatible with school operations.

Issues and Analysis:

Facility-use decisions require the District to balance community access with its primary responsibility to educate students and safely operate schools. The amended Rules make District use the first priority, require Community Users to meet defined conditions, and allow restrictions when a proposed use would disrupt programs, create an unreasonable safety or operational burden, conflict with law or District policy, or expose District property to unacceptable risk.

The Civic Center Act and California Code of Regulations distinguish among categories of users and activities, govern when districts may or must make facilities available, limit what charges may be imposed, and set requirements for the District’s cost-recovery methodology. The amended Rules incorporate those requirements along with the Board’s directives in prior resolutions.

Following adoption of the amendments, and before implementation in July 2027, the Facilities Services Division will issue the administrative regulations after coordination with the Office of the General Counsel, Budget Services, Risk Management, Information Technology Services, regional and school-site leadership, and other affected offices.
